TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SARVOKASH TECHNOLOGIES INDIA PRIVATE LIMITED, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED THE TOTAL AMOUNT PAID BY YOU TO US FOR THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
9. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Bagalkot District, Karnataka State, India.
